Personnel Records: Best Practices For Responding To File Requests & Avoiding Penalties
January 30, 2024, 10 – 11 AM PT
Barran Liebman Series
Zoom Event
With the rise in employment-related claims brought by current and former employees, human resource professionals are fielding an increased number of personnel file requests in both Oregon and Washington. While most employers maintain an “employee file” for each respective employee, rules and regulations require very specific types of information be included. The disconnect between what many employers traditionally think of as an “employee file” and what must actually be produced under state law, often leads to confusion and the potential exclusion of information that is otherwise legally required for production.
This Barran Liebman Webinar will discuss the following:
-
Strategic considerations involved in responding to requests ahead of potential litigation;
-
Obligations for the production of pay records;
-
Identification and production of documents used in the decision to take adverse employment action; and
-
Identification of documents to be withheld on the basis of the attorney-client privilege and/or work product doctrine.
